1. Agreement
By downloading, accessing, or using HAKUNA, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use HAKUNA. If you use HAKUNA on behalf of an organization, you confirm that you have authority to bind that organization.
2. General wellness only
HAKUNA provides general wellness information for personal reflection. It is not a medical device and does not provide medical advice, diagnosis, treatment, emergency monitoring, or disease prevention. Body Load and any suggested action are estimates and may be incomplete, delayed, or inaccurate.
Do not use HAKUNA to make urgent medical or safety decisions. Seek advice from a qualified healthcare professional for health concerns, and contact local emergency services when immediate help is needed.
3. Requirements and permissions
HAKUNA requires compatible Apple devices, software, and sufficient Apple Health data. Apple controls when Apple Watch records signals, and HAKUNA cannot guarantee continuous, real-time, or on-demand measurements. You are responsible for device connectivity, permissions, and keeping software current.
4. Subscriptions and billing
Paid features may be offered through auto-renewing App Store subscriptions. Available plans, localized prices, billing periods, introductory offers, and eligibility are shown in the App Store purchase interface and control over conflicting website descriptions.
- Payment is charged to your Apple Account after purchase confirmation.
- Subscriptions renew automatically unless cancelled before renewal under Apple's rules.
- You can manage or cancel subscriptions in your Apple Account settings.
- Deleting HAKUNA does not cancel a subscription.
- Refund requests are handled by Apple under its policies and applicable law.
5. Acceptable use
You may use HAKUNA only for lawful, personal purposes. You must not:
- interfere with, probe, or attempt unauthorized access to the app or its systems;
- circumvent subscription, security, or entitlement controls;
- reverse engineer or redistribute HAKUNA except where law expressly permits;
- use HAKUNA to harm others, violate rights, or misrepresent its wellness outputs as medical conclusions.
6. Intellectual property
HAKUNA, its software, product design, content, and branding are owned by Nopanicehy Limited or its licensors and are protected by applicable laws. These terms give you a limited, personal, non-transferable, revocable right to use HAKUNA; they do not transfer ownership.
7. Availability and changes
We may improve, change, suspend, or discontinue features. Health samples, Watch sync, complications, subscriptions, and platform services may be delayed or unavailable for reasons outside our control. We do not promise uninterrupted or error-free operation.
8. Disclaimers and liability
To the fullest extent permitted by law, HAKUNA is provided “as is” and “as available,” without warranties of fitness for a particular purpose, merchantability, non-infringement, accuracy, or availability.
To the fullest extent permitted by law, Nopanicehy Limited will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, or decisions made in reliance on HAKUNA. Nothing in these terms limits liability that cannot legally be limited.
9. Termination
You may stop using HAKUNA at any time. We may suspend or terminate access if you materially violate these terms, create risk or harm, or if required by law. Provisions that by their nature should survive termination will remain in effect.
10. Governing law
These terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. Courts in Hong Kong have non-exclusive jurisdiction, except where mandatory consumer law gives you rights to bring a claim elsewhere.
